Endangered Habitats League, represented by Chatten-Brown Law Group, challenged the approval by the City of Encinitas of a proposed condominium project near the Batiquitos Lagoon, for violations of the California Environmental Quality Act and California Coastal Act. Following months of discussion, a settlement has been reached that reduces impacts to rare habitat, limits development to one side of a canyon, and forms an acceptable Multiple Habitat Conservation Program (“MHCP”) preserve segment. This revised project was approved by the City Council in early December 2024. Other positive results of the settlement agreement and revised project include restoration of coastal sage scrub in the on-site preserve and maintenance of the gnatcatcher population in and around Batiquitos Lagoon.
