JUDGE RULES IN FAVOR OF COMMUNITY GROUP PQ-NE ACTION GROUP, REPRESENTED BY CHATTEN-BROWN LAW GROUP.

On February 3, 2023, the San Diego Superior Court granted PQ-NE Action Group’s Petition for Writ of Mandate overturning the approvals of the Junipers Project and requiring all on-going development to cease until the City complies with CEQA.

In particular, the judge agreed with PQ-NE Action Group that the City failed to adequately consider the cumulative impacts of several large projects in the immediate area, including on fire safety. In granting the community group’s petition for writ of mandate, the court concluded that the City’s “decision to exclude Millennium PQ and the Trails projects was not reasonable under the facts. In the court’s view, the close proximity of these projects – particularly Millennium PQ, which is adjacent to the Project – renders the City’s decision all the more arbitrary.”
